Terms and Conditions

Methodist Health System MyChart Terms of Use & USER Access Agreement

Methodist Health System ("MHS") is pleased to offer the MyChart site as a courtesy for the exclusive use of established past and present patients and families of MHS facilities. MyChart offers secure viewing to established patients that wish to view parts of their medical records.

I. General Policies and Procedures

A. MyChart Function & Utility

MyChart can be used for the following purposes:

• Secure send and receipt e-mail and messaging for non-urgent needs. • Online viewing and capability to print commonly required documents and items, including "Continuity of Care" and "Health Summary" documents; • Online viewing of, with ability to submit information updates for, patient profile, contact, and demographic information (i.e., address, phone numbers, e-mail, etc); • Online health record information viewing, including allergies, medications, current problems, and past medical history;

Accordingly, you may use MyChart to obtain lab results, view select reports, receive appointment reminders, and to confirm accuracy of and/or make submit updates to your demographic information.

The MHS MyChart offers the following functionality and components:

Homepage: The Homepage allows you to view the components of your medical record.

Messages: Allows you to send and receive secure messages to/from your physician(s). *Note: This option is only available if your physician(s) have opted to use this functionality within My Chart. Use of this is very similar to standard email. If you have sent a message to your physician's office and haven't received a response within two (2) days, please contact your physician office by phone.

Health Record: Allows you to view information entered into core parts of your electronic health record (e.g. allergies, lab results, radiology reports, medication lists, and visit history, etc.). These are available for you to review as well as print for other physicians or to keep for your records.

Medications: Allows you to view your current medications entered by your physician or

clinical staff.

Appointments: Allows you to view upcoming appointments.

Profile: Contains your demographic information, insurance and personal contacts. Allows you to view and request changes to your information.

Prescription Refill Requests: Allows you to request refills directly from your doctor anytime. If you have sent a refill request to your physician's office and haven't received a response within twenty-four (24) hours, please contact your physician’s office directly by phone. *Note: This option is only available if your physician(s) have opted to use this functionality within My Chart. Use

B. Health Information Display Within MyChart

MyChat will display certain information from your medical record, but will not necessarily display all of the information found in your medical record. If you believe that the information displayed as a part of your medical record on MyChart is inaccurate, you may request that MHS amend this portion of your medical record by submitting a written request as outlined in the MHS Notice of Privacy Practices.

MHS will provide you with a complete copy of your medical record at your request. For this service, fees may apply pursuant to Texas and Federal law. To request and obtain a complete copy of your medical record, or to relate any questions or concerns about the accuracy or completeness of your health information as it appears within MyChart, please contact our Medical Records Department in MHS Health Information Management at 214-947-7600.

C. MyChart Communications May Become a Part of Medical Record

Communications made using MyChart may be included in your permanent medical record. Therefore, it is important for you to ensure that:

• All information that you enter via MyChart is true, accurate, complete;

• Your MyChart demographic and contact information is timely updated to reflect any changes; and that

• You are specific and precise when communicating using MyChart.

D. MyChart Information Confidentiality & Privacy

Any personal information you submit using MyChart will be governed by the MHS Privacy Practices and MHS Medical Staff Notices of Privacy Practices (the "Notices"). These Notices contain information about the privacy practices and policies of MHS, its facilities, and its medical staff, and explain how private health information is handled in and by MHS facilities. You may review the MHS and MHS Medical Staff Notices of Privacy Practices at the following link: http://www.methodisthealthsystem.org/privacynotice.

By communicating through MyChart you are agreeing that you understand that, for

operational purposes, a variety of healthcare and administrative personnel (nurse practitioners, physician assistants, registered nurses, certified medical assistants, clerks, etc) will be involved in reading, processing and replying to messages and information submitted through MyChart (similar to how phone communication is handled).

To the extent there is any inconsistency between these Terms of Use and the MHS Notice of Privacy Practices, these Terms of Use shall govern.

E. MyChart Operation & Administration

MyChart is monitored and checked during the MHS Health Information Management hours of operation, which are 8:00 am to 5:00 pm CST, Monday through Friday. You are encouraged to use MyChart at any time. Messages submitted before or after operational hours will be reviewed and an effort will be made to respond on the next business day.

Reasonable efforts will be made to respond to email inquiries within one (1) business day, but no later than three (3) business days, after receipt. Response time may be longer if MyChart service is interrupted for maintenance, upgrades, or emergency repairs related to events beyond our control. DO NOT ATTEMPT TO COMMUNICATE A MEDICAL OR PSYCHIATRIC EMERGENCY OR OTHER URGENT SITUATION USING MYCHART. If you believe you have a medical or psychiatric emergency, you should call 9-1-1 or seek emergency care immediately.

By registering for an account and/or using MyChart, you are agreeing not to hold MHS, its entities and affiliates, its physician practices, physicians, providers or any of its staff, in any way liable or responsible to you for any such modification, suspension, or disruption of MyChart communication.

F. Medical Advice and Information Disclaimer

Information within MyChart is not intended to be used for medical diagnosis or treatment. You should always seek the advice of your physician or other qualified health care professional with any questions you may have regarding any results, medical symptoms or a medical condition. Methodist Health System assumes no responsibility for how you use the information you obtain from this Site.

MyChart may from time to time include information posted by MHS in the form of news, opinions, or general educational materials that should not be construed as specific medical advice or instruction from MHS or MHS staff. Information posted by MHS within MyChart should not be considered complete, nor should it be interpreted or relied upon for medical diagnosis or to suggest a course of treatment for a particular patient. It does not constitute any attempt to practice medicine, and the use of the MyChart DOES NOT establish a doctor-patient relationship.

Neither MyChart nor any other application available through this Site is a substitute for appropriate and timely contact with your health care provider. This Site is not a substitute for consultation with your health care provider. You should never change or stop any course of treatment prescribed by your health care provider without first consulting him or her. Never disregard professional medical advice or delay in seeking it because of something you may have read on MyChart. DO NOT use MyChart to communicate an (i) emergency, (ii) urgent issue, or (iii) sensitive information (e.g. HIV, Mental Health, work-excuses, etc). Again, if you think you have a medical or psychiatric emergency, call 9-1-1 or go to the nearest hospital.

G. Third-Party Sites & Links As a service and convenience, MyChart may provide or include links to other web sites that are not owned or controlled by MHS ("Third Party Web sites"). MHS is not responsible for the content, security or the privacy practices of Third Party Web sites. By clicking on a third party link, you will leave the MHS website. Any website you visit by a link from this site is solely the responsibility of the vendor, merchant or other party providing the site and you do so solely at your own risk. The content of, including materials and information contained on, any site to which you link from this site is solely the responsibility of the provider of that web site. Please review the privacy statement and any terms of use of any Third Party Web site you visit. Unless MHS specifically advises otherwise, links to Third Party Web sites do not constitute or imply endorsement by MHS of those sites, the information they contain, or any products or services they describe. MHS receives no payment or other remuneration in exchange for your linking to or using any Third Party Web sites. MHS is not responsible for any such third party content that may be accessed via this site nor the organizations publishing those sites, and hereby disclaims any responsibility and accepts no liability for any damage or loss, however caused in connection with the use of or reliance on any information, material, products or services contained on or accessed through any such linked website. If you decide to access a link from this site, you do so at your own risk. By accessing a link from this site, you are expressly agreeing to fully release MHS from any and all liability, damages or losses you may incur. MHS is not responsible for the content, security or the privacy practices of integrated services. Any integrated service is solely the responsibility of the vendor, merchant or other party providing the service and utilization is solely at your own risk. MHS hereby disclaims any responsibility and accepts no liability for any damage or loss, however caused in connection with the use of or reliance on any integrated services contained on MyChart. If you decide to utilize an integrated service from this site, you do so at your own risk. By utilizing an integrated service from this site, you are expressly agreeing to fully release MHS from any and all liability, damages or losses you may incur.

II. MyChart Security

MyChart is a webpage that uses encryption and other security measures designed to attempt to keep unauthorized persons from reading communications, information, or attachments. The communication and information-viewing made available through MyChart is designed to attempt to prevent unauthorized parties from being able to access or read messages while they are in transmission through the use of encryption. Other security measures protect information maintained within MyChart. The website for MyChart has a "trusted site" certificate, which is viewable from your browser's task bar. (You can learn more about trusted sites by going to http://windows.microsoft.com and searching: "When to trust a website.")

A. MyChart Communications

Secure messages and information are designed to be read only by someone who knows the right password or pass-phrase to log into MyChart. Secure Messaging can be a valuable communications tool, but has certain risks. Keeping messages secure depends upon two (2) additional factors controlled by you:

• Secure messages reaching the correct email address, and • Authorized individual(s) being able to access secure messages

Only you can ensure the presence of these two (2) necessary factors. We need you to make sure that we have your correct email address and that you inform us if that e-mail address changes. You also need to keep track of who you have provided access to your MyChart account, so that only you or someone you have authorized can see messages received or other information in your MyChart account.

You should protect your MyChart login information from anyone whom you do not want to access your MyChart account and notify us immediately of any unauthorized use of your login information or if you believe that your login is no longer confidential. We will not answer questions or send protected health information by regular email. Even with these security measures, we cannot guarantee the confidentiality, security or integrity of MyChart information. MHS will not be responsible for any breach or loss you may incur as a result of someone else misusing your password with or without your permission.

To the fullest extent allowed by law, you expressly agree to fully waive, release and discharge MHS, its entities and affiliates, its physicians, physician practices, providers or any of its staff from any and all claims, liability damages and or losses for network infractions.

B. MyChart Security & Confidentiality Practices

To maximize the website’s usefulness while attempting to ensure security protections, the following practices are observed and agreed-to:

• All email address lists will be kept confidential and such lists will not be shared with other parties, unless necessary to carry out MyChart operations (e.g. perform system upgrades to the website or required by law.)

• All e-mails and messages sent by MHS to you using MyChart will be encrypted for security;

• All e-mails from you to MHS or MHS staff members must be sent through MyChart. E-mails sent outside MyChart are not secure, and vulnerable to interception by outside, unauthorized persons;

If "Contact Us" through MyChart is not accessible for any reason, please contact Medical Records directly at 214-947-9100.

By registering for an account and/or using MyChart, you agree not to hold MHS or any of its staff or physicians liable for network or security infractions beyond our control.

C. Minor Eligibility For Your MyChart Account

Unless otherwise allowed by law, an individual must be age 18 or older to request a MyChart account. If allowed by law, Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section of these Terms of Use. Under State and Federal law, there may be circumstances where you will not be allowed access to your child's health information. Because of these legal requirements, MHS reserves the right to deny you access as appropriate under the law.

D. MyChart Availability & Integrity

Access to MyChart is optional. MyChart is provided as a courtesy to MHS patients and families, and may be limited, suspended or terminated at any time and for any reason. MHS does not represent that the site will be fully available continuously, or in any particular country or jurisdiction.

Further, while the MyChart site attempts to remain current, health care information changes rapidly, and this site should not be relied upon as current, comprehensive and error-free. MHS may revise the information on the site or otherwise change or update the site, including these Terms of Use, without notice to you. You are responsible for regularly viewing these Terms of Use to see if there have been any changes to our policies that may affect you. Your continued use of MyChart constitutes your agreement to all such terms, as they may be revised and amended from time to time.

III. MyChart Logistics - Requesting & Obtaining Account & Access

To obtain a MyChart account, you must: request access from Methodist Health System; be at least eighteen (18) years old (see Minor Eligibility section herein) and a patient, or former patient or proxy for a patient established through a previous visit to a participating MHS facility; review and understand the MyChart Terms of Use, as described herein; complete and submit a physical or electronic signed User Access Agreement (the "Agreement"), as described in detail below. It is important for you to know that once you grant proxy access to someone to your medical information

through MyChart, they will have complete access to any and all of your medical information contained on MyChart. By granting proxy access to someone, you are expressly releasing MHS fully and completely from any and all claims, damages, losses and liability that may occur as a result of the proxy access.

A. Electronic Submission User Access Agreement

After reviewing these MyChart Terms of Use, you may complete the User Access Agreement and electronically enroll for an account by selecting "Accept," which will create an electronic signature of acceptance whereby you confirm that you have read, fully understand, and are agreeing to comply fully with these Terms of Use and the User Access Agreement. If this accurately describes your intent, then simply click on "Accept" to submit the Agreement.

Upon electronically submitting your User Access Agreement, you should receive a "Welcome" email containing instructions on completing your enrollment and a link to the MyChart login screen. We try to respond to access requests within one (1) business day, but the process can take up to three (3) business days. The Welcome e-mail will include details on how to create your personal MyChart l log in and password. You must follow these instructions to gain access to and begin using MyChart.

If you have not received a Welcome email from us within three (3) working days after electronically submitting your User Access Agreement, please contact Medical Records at 214-947-7600 and notify the receptionist.

B. Physical Submission - User Access Agreement

MHS patients will be offered the opportunity to enroll for a MyChart account when patients are physically present on campus, including:

• During Admission Process. When a patient registers for admission to an MHS hospital, the MHS "Admitting" desk staff will ask during registration if the patient would like access to the MyChart. If the patient is interested in gaining access to MyChart, the patient will be given a paper copy of both these Terms of Use and of the User Access Agreement. The admitting staff will request that the patient read the Terms of Use, and then if the patient agrees with all the Terms of Use, they will sign and submit the User Access Agreement to the Admitting Staff.

Once Admitting receives the patient's signed User Access Agreement, Admitting staff will provide the patient with a card that includes the patient's medical record number so the patient can self-enroll. The patient is then responsible for completing enrollment upon accessing MyChart. Once the Patient receives the card with the patient's medical record number on it, the patient is responsible for ensuring the card is not misplaced and after use is properly disposed of.

• When Requesting Medical Records Or Adding Proxy User. When a patient comes to the Medical Records Department to request copies of records for personal use or to request the addition of a Proxy to an existing MyChart Account, the patient will likewise be given physical, paper copies

of the Terms of Use and of the User Access Agreement (or Proxy Authorization, as appropriate) by Medical Records staff for completion and signature. Medical Records staff will request that the patient read the Terms of Use, and then if the patient agrees to the Terms of Use will need to physically sign and submit the User Access Agreement or the Proxy Authorization. Upon receipt of the patient's completed, signed Agreement or Authorization, the patient may complete enrollment by either:

Requesting that a "Welcome" e-mail be sent to the provided e-mail account to enable the patient or proxy to create an account and complete enrollment; or Requesting that Medical Records create the account and complete enrollment, generating a temporary password and allowing the patient to log-in from the Medical Records Department.

Patients or proxy users that complete enrollment through (and receive/use temporary passwords generated by) the Medical Records Department should change the password at the time of log-in to something only the user would know to ensure confidentiality. This can be done by clicking on the "Preferences" area at the bottom of the MyChart webpage, and is essential to ensure your information remains secure and private.

C. Proxy Access

Individuals age 18 or older, or minors who have the legal right to access, may request proxy access to another individual's information on MyChart by completing the Proxy Access Consent Form and submitting it to the Medical Records in the MHS Health Information Management Department. Proxy access will be granted only to parties with parental rights or legal guardianship over the MHS patient and only to the extent that the party requesting proxy access can demonstrate the legal right to the patient's medical information. Only one person may be granted proxy access to MyChart for a given patient. If the proxy's legal relationship to the MHS patient changes, the proxy must immediately inform MHS by contacting Medical Records (in the Health Information Management Department) at 214-947-7600 or by sending written notice to Methodist Health System, ATTN Health Information Management, 1441 N. Beckley Ave., Dallas, Texas 75203. MHS reserves the right to revoke proxy access at any time for any reason.

IV. RELEASE, WAIVER, AND HOLD HARMLESS By Selecting "I Accept" Or Physically Signing And Submitting A User Access Agreement:

I. YOU UNDERSTAND AND ACKNOWLEDGE THAT THERE IS INHERENT RISK IN UTILIZING THE INTERNET AND/OR SHARING YOUR PASSWORD FOR WHICH MHS CANNOT BE HELD RESPONSIBLE, THEREFORE, YOU AGREE YOU ARE ACCESSING THE MYCHART COMPLETELY AT YOUR OWN RISK. II. YOU ARE AGREEING TO ASSUME ANY AND ALL RISK ARISING OUT OF ACCESSING, DOWNLOADING, SHARING AND/OR PRINTING ANY OR ALL OF YOUR MEDICAL INFORMATION FROM MYCHART.

III. YOU ARE EXPRESSLY AGREEING TO FULLY WAIVE, RELEASE AND

DISCHARGE MHS AND ANY OF THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS, AGENTS, REPRESENTATIVES, AND EMPLOYEES, (COLLECTIVELY "RELEASEES"), FROM ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, OR OTHER EXPENSES OF ANY NATURE WHATSOEVER (COLLECTIVELY "CLAIMS") FOR ANY DAMAGES ARISING OUT OF OR RESULTING FROM YOUR ACCESSING AND UTILIZING THE FEATURES OF THE MYCHART, INCLUDING BUT NOT LIMITED TO PRINTING YOUR PATIENT INFORMATION, GRANTING PROXY ACCESS, SAVING YOUR PATIENT INFORMATION OR ANY OTHER ACCESS AND OR USE OF YOUR PATIENT INFORMATION, EXPRESSLY INCLUDING BUT NOT LIMITED TO ANY CLAIMS ARISING FROM ANY RELEASEE'S OWN NEGLIGENCE.

IV. YOU ARE AGREEING THAT THIS RELEASE, WAIVER AND HOLD HARMLESS WILL BE BINDING ON YOU AND YOUR EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, HEIRS AND MINOR CHILDREN

IF YOU DO NOT AGREE IN TOTAL TO THESE TERMS OF USE, DO NOT ELECTRONICALLY SELECT "I ACCEPT" OR PHYSICALLY SIGN AND SUBMIT A USER ACCESS AGREEMENT, AND DO NOT USE THE MHS MYCHART SITE.

MyChart USER ACCESS AGREEMENT

I acknowledge that I have read and understand the Terms of Use and requirements for access to and use of MyChart. By signing below, I agree to comply with the Terms of Use for using MyChart and with all procedures and guidelines stated therein.

BY ACCEPTING THIS MYCHART ACCESS AGREEMENT, OR THROUGH USE OF MYCHART AFTER ACCEPTANCE, YOU SIGNIFY YOUR AGREEMENT TO ALL OF THE MYCHART TERMS OF USE AND RELEASES, AS ABOVE.
